The government of Sindh, Finance Department issued a Notification on 05 December 2022 in connection with the Clarification about Family Pension to Divorced Daughter, Widow Daughter, and Sister. The details are as under:
Govt. of Sindh issued a circular regarding the clarification made in interpreting Rule 4.10(2)(A)(iii), Rule 4.10(2)(B)(v),(vi) and (vii), and Rule 4.10 5 (a) and (b). The content of the Circular is as follows:
Clarification about Rules of Family Pension
In Continuous with Finance Departmental Office Memorandum, dated 07th April 2016, and advice of law, Parliamentary Affairs, and Criminal Prosecution Department received through Regulations Wing, SGA&CD, the following clarification is made in interpreting Rule 4.10(2)(A)(iii), Rule 4.10(2)(B)(v), (vi) and (vii) and Rule 4.10 5 (a) and (b).
A widow at the Time of Death (Daughter)
If the daughter of the deceased pensioner is a widow at the time of the death of the pensioner/family pensioner, she will be entitled to the transfer of the family pension. However, if she becomes a widow after the date of the death of the pensioner/family pensioner, the family pension shall not be granted/ re-granted.
Death of Pensioner and Widow Daughter on the Same Day
It is further clarified that if the death of the pensioner occurs on the same day, the family pension shall be transferred to Widow’s daughter. However, if she becomes a widow even a day later after the death of the pensioner, the family pension shall not be granted / re-granted.
Clarification of Family Pension to Divorced Daughter if Divorce to Daughter at the Time of Death of Employee
Similarly, if the daughter or decreased pensioner is divorced at the time of death of the pensioner, she will be entitled to the transfer of the family pension. However, if she is divorced after the death of the pensioner, the family pension shall not be granted/ re-granted.
Divorce to Daughter and Death of the Employees Same Day
Furthermore, if the death of the pensioner and the divorce of the daughter of the pensioner occurs on the same day, she will be entitled to the transfer of the family pension. However, if the event of divorce occurs even a day after the death of the pensioner/ family pensioner, the family pension shall not be granted/ re-granted.
Condition for Widowed Sister and Divorced Sister
The above-mentioned clarification will also be applicable to the widowed, and divorced sister and also in case of re-marriage of a widow and unmarried/ widow/ divorced daughter/ sister.
